These terms are an agreement between you and Swervo ("we", "us") for using the Swervo app and website. By creating an account or using Swervo, you agree to them and to our Privacy Policy. If you don't agree, please don't use Swervo.
Who can use Swervo
You must be at least 16 to use Swervo. If you're under the age of majority where you live, you need a parent or guardian's permission, and they agree to these terms too.
Keep your account details accurate and your password to yourself. You're responsible for what happens on your account, so tell us straight away if you think someone else is using it. One account per person, and don't sell or hand over your account.
Ride safely
Swervo helps you plan and navigate rides. It doesn't replace your own judgment, and using it doesn't make a road or a ride safe.
- Obey the law and the road. Follow traffic laws, road signs and signals, and instructions from police. If the app's directions conflict with any of them, or with what's safe, ignore the app.
- Keep your eyes on the road. Set up your route before you ride, mount your phone securely where the law allows, and rely on voice guidance. Only handle the app when you're safely stopped.
- Maps and routes can be wrong. Directions, maps, speed limits, travel times, elevation and curvy-road ratings may be inaccurate, incomplete or out of date. A route may include roads that are closed, unpaved, private, seasonal or unsuitable for your motorcycle, your experience or the weather. Curvy and Supercurvy routes are demanding by design.
- It's your ride. You're responsible for your riding, for your motorcycle being roadworthy, licensed and insured, for your gear and for the decisions you make on the road. Ride within your ability and the conditions.
- Don't rely on your phone alone. The app needs battery, GPS and often a mobile signal, and any of them can fail. On long or remote rides, carry a backup, such as a paper map, a charger and a plan someone else knows about.
Safety Tracking
Safety Tracking lets people who have your link follow your location while you share it. It depends on your phone having battery, signal and location access, and on the app running, so it can stop updating without warning.
It isn't an emergency service. It doesn't detect crashes, alert anyone or call for help. In an emergency, call 911 or your local emergency number.
Share your link only with people you trust, and never use Swervo to track anyone without their knowledge and consent.
Meets and group rides
Meets and group rides are organized by riders, not by Swervo. We don't check riders, hosts, routes or meeting places, and we aren't responsible for what happens at a meet or on a ride. You take part at your own risk.
Hosts: describe your meet honestly and let riders know if plans change. Everyone: ride your own ride (you never have to keep up with a group) and treat other riders with respect.

Your content
You keep ownership of what you add to Swervo: posts, photos, routes, comments, meets and messages ("your content").
So we can run Swervo, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example, resize photos), display and share your content within Swervo, following the audience you choose. The licence ends when you delete the content or your account, except for content you've shared that others keep (such as messages) and copies in backups for a short time.
Make sure you have the right to post what you post, including permission from the people in your photos, and that it doesn't break the law or anyone's rights. You're responsible for your content.
When you make a route public, other riders can view, save, navigate and export it.
If you send us ideas or feedback, we can use them without owing you anything.
Rules for using Swervo
Don't use Swervo to:
- break the law, or post anything illegal
- harass, threaten, bully or stalk anyone, or share someone's personal information or location without their consent
- post hateful, sexually explicit, violent or graphic content
- encourage dangerous or illegal riding, like street racing or stunts on public roads
- post spam or scams, or impersonate anyone
- upload viruses or harmful code, or try to get into accounts, data or systems you aren't allowed to
- scrape or collect data from Swervo by automated means
- copy, reverse-engineer or interfere with the app or our servers, except where the law allows
You can report posts, comments, meets, routes, messages and riders that break these rules from within the app, and block any rider. We review reports, and may remove content, and suspend or close accounts that break these terms, without notice where that's needed to keep people safe.
Maps and other services
Maps and map data © Mapbox and © OpenStreetMap contributors. You can improve the map directly.
Swervo relies on other companies' services (see our Privacy Policy), which have their own terms. We aren't responsible for their services, or for other websites linked from Swervo.
Our app
Swervo's name, logo, design and software belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial use, under these terms. The app includes open-source software, which is covered by its own licences.
If you got Swervo from the App Store
Apple's Standard End User License Agreement also applies. These terms are between you and Swervo, not Apple. Apple isn't responsible for the app or its content and has no duty to support it. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them.
Disclaimers
Swervo is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties, express or implied, that it will be uninterrupted, error-free or fit for a particular purpose, or that its maps, routes, directions or other information are accurate, complete or safe to follow.
Some places don't allow these exclusions, so they may not all apply to you. Nothing in these terms takes away rights you have under consumer protection law that can't be waived.
Limitation of liability
To the fullest extent the law allows, Swervo isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of Swervo or your inability to use it, including from following its routes or directions, taking part in meets or group rides, or relying on Safety Tracking.
Our total liability for any claim about Swervo is limited to the greater of what you paid us in the 12 months before the claim and CAD $100.
These limits don't apply where the law doesn't allow them: for example, in some places, to liability for death or personal injury caused by negligence, or for fraud.
Indemnity
To the extent the law allows, you agree to cover the claims, losses and costs (including reasonable legal fees) that others bring against us because of your content, your breach of these terms or your misuse of Swervo.
Ending your use
You can stop using Swervo at any time and delete your account, in the app or by asking us, as described in our Privacy Policy.
We may suspend or close your account if you break these terms, if the law requires it or if we stop offering Swervo, with notice where reasonable. The sections on your content (for copies we may keep), disclaimers, liability, indemnity and disputes still apply afterwards.
Changes
We may change or stop features of Swervo, and update these terms. If we make a significant change to these terms, we'll tell you in the app or by email before it takes effect. If you keep using Swervo after that, you accept the new terms.
Governing law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and disputes will be decided by the courts of Ontario. If you're a consumer living elsewhere, you keep the protection of your local consumer laws and any right to bring a claim in your local courts.
If you have a problem, please contact us first so we can try to sort it out.
General
These terms and our Privacy Policy are the whole agreement between you and us about Swervo. If part of them can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You can't transfer your rights under these terms; we can transfer ours to whoever takes over Swervo.
